4. Quotes and Contracts

• Quotes are valid for 30 days unless otherwise specified
• Prices may vary based on site conditions, material costs, and design changes
• All quotes exclude GST unless specifically stated
• Additional costs may apply for variations or unforeseen circumstances

4.2 Contracts

• All construction work requires a signed contract
• Contracts comply with the Construction Contracts Act 2002
• Payment schedules are outlined in individual contracts
• Changes to scope require written approval and may affect pricing and timelines

5. Consumer Rights

Under the Consumer Guarantees Act 1993, you have certain rights regarding our services:

• Services must be performed with reasonable care and skill
• Services must be fit for purpose and delivered within reasonable time
• Materials must be of acceptable quality and durable
• You may seek compensation for failure to meet these guarantees

These rights cannot be excluded by contract for consumer transactions.

6. Building Warranties

6.1 Statutory Warranties

As a Licensed Building Practitioner, we provide statutory warranties under the Building Act 2004:

• 12 months for defects and workmanship issues
• Additional warranties may apply as specified in contracts
• Warranties are subject to normal wear and tear exclusions

6.2 Product Warranties

Manufacturer warranties apply to materials and fixtures as provided by suppliers.

7. Payment Terms

• Payment schedules are detailed in individual contracts
• Progress payments are made based on work completed
• Final payment is due upon practical completion
• Late payment fees may apply as per contract terms
• We reserve the right to suspend work for non-payment

8. Liability and Insurance

We maintain appropriate insurance coverage including:

• Public liability insurance
• Professional indemnity insurance
• Contractor's works insurance

Our liability is limited to the extent permitted by law and as specified in individual contracts.

9. Health and Safety

We are committed to maintaining safe work practices in accordance with the Health and Safety at Work Act 2015. Site safety requirements and restrictions will be communicated and enforced during construction.

10. Intellectual Property

• We respect the intellectual property rights of architects and designers
• Clients retain ownership of their specific design elements
• We may use project images for marketing purposes with client consent
• Our processes and methodologies remain our intellectual property

11. Privacy

Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 2020.

12. Dispute Resolution

12.1 Construction Disputes

Construction-related disputes are subject to the Construction Contracts Act 2002 and may be referred to:

• Adjudication under the Construction Contracts Act
• Building disputes tribunal (where applicable)
• Alternative dispute resolution processes

12.2 General Disputes

Other disputes will be resolved under New Zealand law in the appropriate New Zealand courts.
